Terms Of Use

Emergency Management Telecommunications, Inc. (EMTEL) a Florida Corporation provides its service to you subject to the following Terms of Use (Terms) and EMTEL’s Privacy Policy for its Services. In addition, when using EMTEL Services, you and EMTEL will be subject to any guidelines or rules applicable to these Services, which EMTEL may communicate to you or post from time to time. These guidelines or rules and EMTEL’s Privacy Policy shall be deemed part of the Terms.


EMTEL provides users with applications and services that comprise “A Total Solution for Emergency Management Telecommunications” a geo-graphical sensor, notification and communication delivery system (collectively the “PRODUCT”). Unless explicitly stated otherwise, any new features that augment or enhance the current PRODUCT, including any new products, will be subject to the Terms.


In order to use the PRODUCT, you must obtain access to (a) the World Wide Web, either directly or through devices that access Web-based content, or (b) via the OutReach911™ wireless laptop command and control computer. EMTEL provides the OutReach911™ Tough Book front end computer. EMTEL is not responsible for providing the connectivity to the World Wide Web if the customer is providing its own computers to activate the RESPOND® PRODUCT.


All information must be accurate, complete, current, and accessible. In consideration of your use of the PRODUCT, the customer agrees to: (a) provide true, accurate, current and complete information about the customer and those who you may wish to contact ("Contacts") when utilizing the PRODUCT (such information being the Registration Information “INFO”) and (b) maintain and promptly update the INFO to keep it true, accurate, current and complete. If you authorize EMTEL to do so, your Contacts will be allowed access to their personal Registration Data to make modifications or changes via a Registration Form, mounted on the customer web site. If customer or any Contact provides any information that is untrue, inaccurate, not current or incomplete, or EMTEL has reasonable grounds to believe that such information is untrue, inaccurate, not current or incomplete, customer understands that any notifications sent via the PRODUCT may not reach the intended Contact.


You may designate up to the number of users (each, an "Authorized User") under your account, which corresponds to the level of Services you are receiving from EMTEL, and you may provide and assign access and passwords to such Authorized Users. You will be responsible for the confidentiality and use of your access number(s), password(s), and account number(s). You will be responsible for all electronic communications, including account registration and other account holder information, email and financial, and other data ("Electronic Communications") entered through or under your access number(s), password(s) or account number (s). EMTEL will act as though any Electronic Communications it receives under your access number(s), password(s) or account number(s) will have been sent by you. You agree immediately to notify EMTEL if you become aware of any loss or theft or unauthorized use of any of your access number(s), password(s) and/or account number(s).


• Customer acknowledges and agrees to the following with respect to use of Electronic Communications through the PRODUCT:

• Customer will not use the PRODUCT for any purpose that is unlawful, abusive, harassing, libelous, defamatory, obscene or threatening;

• Customer may not knowingly restrict or inhibit any other user from using and enjoying the PRODUCT;

• Customer may not impersonate any other person or entity, or misrepresent Customer affiliation with any other person or entity;

• Customer may not knowingly post or transmit any information or software which contains a virus, trojan horse, worm or other harmful component;

• Customer will not in any way express or imply that any opinions contained in Customer’s Electronic Communications are endorsed by EMTEL, or that the accuracy of any facts or circumstances described in Customer Electronic Communications have been verified by EMTEL, and Customer authorizes EMTEL to attach a legend to any Electronic Communication sent via the EMTEL PRODUCT to this effect;

• Customer may not use the PRODUCT in any way for sending Spam. Spam is unsolicited email directed to people not personally known to you, including but not limited to junk mail, chain letters or other unsolicited bulk email, commercial or otherwise or any email sent that EMTEL reasonably believes constitutes Spam, based on applicable laws and industry practices.


All of the PRODUCT individual element names exhibiting ™ or ® are trademarks of the EMTEL Corporation; “Total Solution To Emergency Management Telecommunications”, “Solutions for a Dangerous World”, “RESPOND® All Hazard Telecommunication System” are also the trademarks of EMTEL Corporation, SchoolCall911®, all of which are not to be copied, transferred, or utilized in any manner or for any purpose without the written consent of Emergency Management Telecommunications, Inc. EMTEL.
